Terms and Conditions
1. By subscribing to _luma's services ("the Provider"), a brand operated by In Communication LLC, a limited liability company organized in Florida, United States, with its address at 3401 SW 160th Ave, Suite 330, Miramar, Florida 33027, the Client expressly accepts these Terms and Conditions, which govern the contractual relationship between the parties from the moment the first payment is confirmed.
2. The service is provided on a monthly subscription basis, with no mandatory minimum term. Fees are stated and billed in US dollars (USD). The Client may cancel at any time by written notice to the Provider. Cancellation takes effect at the end of the current billing period and does not entitle the Client to a refund of amounts already paid for that period.
3. Payments are made by bank transfer in US dollars, or through another payment method agreed in writing with the Provider. The Provider does not store or have access to the Client's full card details. Prices exclude any applicable taxes, which are the Client's responsibility. Payments in US dollars are invoiced and processed through In Communication LLC, based in Miramar, Florida, and exclude any applicable taxes.
4. Should a payment fail and any automatic retries be exhausted, the subscription will enter an "Overdue" status. The Provider will grant a fifteen (15) calendar-day grace period from that point to settle the payment, notifying the Client in advance. If the payment is not settled within that period, the site will be paused until it is brought current.
5. Content changes such as text, images, pricing, products, and reordering of existing sections are included in the monthly fee at no extra cost and without a limit on volume, grouped into a single monthly request. Text and images produced by the Provider as part of these requests may be generated, in whole or in part, using artificial intelligence.
6. The Landing plan includes one full redesign every three (3) months. The Corporate plan includes one full redesign per calendar year, including the first year of service. Any redesign requested before the applicable window has elapsed will be scheduled for the next available slot at no additional cost.
7. A Landing plan Client may contract additional landing pages for simultaneous campaigns, at an additional charge of USD $39 per month for the second landing page and USD $29 per month for each additional one from the third onward. Additional landing pages must belong to the same Client holding the subscription; using them to host sites for unrelated third parties is expressly prohibited.
8. Not included in the monthly fee, and quoted separately, are features not contemplated in the contracted plan (such as an online store, booking systems, or custom integrations) and Corporate plan routes beyond the five (5) included.
9. Corporate plan only: the Client will acquire full ownership of the source code developed by the Provider upon reaching, whichever occurs first: (i) twelve (12) consecutive monthly payments of active service, with no interruptions; or (ii) eighteen (18) monthly payments of active service in total, regardless of any interruptions. The payment corresponding to the initial development month is not counted toward either period. Reaching this threshold does not by itself alter the contractual relationship or billing in any way, and only takes effect if the Client, having cancelled the subscription, expressly requests the code.
10. On the Landing plan, the source code and design are and always remain the Provider's property, and the Client uses them for as long as the subscription is kept up to date: the landing page stays live only while the service is paid for, and there is no transfer of the source code based on length of payments. Cancellation or prolonged non-payment results in the landing page being taken down, without prejudice to the Client's content, which is theirs at all times.
11. Should a Corporate plan Client cancel the subscription before reaching the threshold described in the previous paragraph and still wish to acquire ownership of the source code, they may do so by paying the equivalent of eighteen (18) monthly fees under the contracted plan, less the monthly payments already made during the subscription.
12. All content provided by the Client — including photographs, text, brand, and logo — is and will remain at all times the Client's exclusive property, with no time or continuity condition attached.
13. The domain name managed by the Provider on the Client's behalf will be registered from the outset with the Client's own details as registrant. Release of the authorization code needed to transfer the domain to another provider is subject, on the Corporate plan, to the same time threshold described above for ownership of the source code. On the Landing plan, the authorization code is released upon cancelling the subscription, provided payments are up to date.
14. The Provider shall not be liable for interruptions, delays, or failures attributable to third-party infrastructure providers, including — without limitation — hosting services, payment processing, and domain registration.
15. To the maximum extent permitted by law, the service is provided "as is", and the Provider's total liability for any claim arising from this agreement is limited to the fees paid by the Client in the twelve (12) months preceding the claim. The Provider shall not be liable for indirect or consequential damages, including loss of revenue, profit, or data.
16. The Client is responsible for the content it publishes and for complying with the laws that apply to its business, including those on privacy, advertising, and accessibility. The site is not designed to collect or store protected health information; the Client agrees not to use forms or other features for that purpose without a prior written agreement with the Provider.
17. These Terms and Conditions may be amended by the Provider, with reasonable advance notice given to the Client by email or WhatsApp. Continued use of the service after such notice constitutes acceptance of the amended terms.
18. This agreement is governed by the laws of the State of Florida, United States, for Clients paying in US dollars, and any dispute shall be submitted to the competent courts of Miami-Dade County, Florida. For Clients paying in Argentine pesos, the laws of the Argentine Republic apply and the dispute shall be submitted to the ordinary courts of the City of Buenos Aires.
